Terms of service

Eligibility and service scope

The Services are designed to let creators maintain public profile and wishlist pages and let buyers fund creator-defined gift listings through discreet.gg checkout. discreet.gg is not a general-purpose marketplace for arbitrary third-party sellers, is not a money transmission service, and, unless a specific product page expressly states otherwise, does not promise platform-run sourcing, inventory management, shipping, fulfillment, or post-purchase logistics for physical goods.

You represent and warrant that you have the legal capacity and authority to enter into this Agreement. If you use the Services on behalf of a company, team, creator management entity, or other organization, you further represent and warrant that you are authorized to bind that person or entity to this Agreement, in which case "you" and "your" will refer to both you and that entity.

Account registration, credentials, and security

To access certain features, you may be required to create an account, verify an email address, connect a third-party login, complete payout onboarding, or satisfy other security or compliance requirements. You agree to provide accurate, current, and complete information and to keep that information updated. You are solely responsible for all activity that occurs under your account, whether or not such activity was specifically authorized by you.

You are responsible for safeguarding your login credentials, devices, authentication sessions, linked third-party accounts, and any secure links delivered to your email address. discreet.gg may treat access to a verified email address or authenticated session as sufficient evidence of account control for sensitive actions including email changes, password resets, payout actions, and account deletion flows. We may revoke sessions, require re-authentication, delay access, or otherwise restrict features when we determine in our discretion that doing so is necessary to protect account integrity, prevent abuse, or satisfy operational, processor, or legal requirements.

User generated content

The Services may permit you to create, upload, publish, submit, store, transmit, or otherwise make available content, data, or materials, including without limitation profile names, handles, biographies, images, banners, social links, wishlist gift titles, wishlist gift descriptions, prices, referral materials, Discord server configuration details, and other creator-facing or buyer-facing submissions (collectively, "User Generated Content"). As between you and discreet.gg, you remain responsible for your User Generated Content and for the consequences of posting or making it available through the Services.

By submitting or making available any User Generated Content through the Services, you grant Discreet Labs LLC a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, format, cache, adapt, modify solely as necessary for technical compatibility, display, perform, distribute, and otherwise use such User Generated Content for the limited purposes of operating, improving, securing, supporting, reviewing, promoting, or providing the Services, including generating public creator pages, previews, share images, moderation outputs, internal support tooling, and archival or audit records.

discreet.gg has no obligation to pre-screen, monitor, verify, or continue hosting any User Generated Content, but reserves the right to review, refuse, remove, disable, edit, or limit access to any User Generated Content at any time and for any reason, including where we believe such content violates this Agreement, third-party terms, card-network or processor rules, or applicable law, or otherwise creates risk for the Services, our users, or our vendors.

Prohibited items, prohibited listings, and prohibited uses

You may not use the Services to list, describe, solicit funding for, receive funding for, purchase, promote, or otherwise facilitate any item, content, service, or transaction that is unlawful, deceptive, abusive, processor-prohibited, or inconsistent with the stated purpose of discreet.gg as a creator gift-funding platform. Without limiting the foregoing, you may not use the Services in connection with any of the following categories:

• illegal goods or services, controlled substances, drug paraphernalia, counterfeit or stolen goods, falsified documents, or any activity that infringes another party's intellectual property, privacy, or publicity rights;
• firearms, ammunition, regulated weapon parts, explosives, hazardous materials, or other dangerous items;
• pornography, adult services, sexually explicit products or services, or mature-audience material designed primarily for sexual gratification;
• gambling, lotteries, raffles, sweepstakes, contests, or games of chance or skill that involve entry fees or prize value;
• tobacco, nicotine, e-cigarettes, vapes, cannabis, CBD products that exceed legal thresholds, prescription products, regulated medical devices, telemedicine, or other regulated health-related goods or services;
• loans, investments, securities, debt collection or relief, money transmission, stored value, cash equivalents, prepaid cards, gift cards, virtual currency, cryptocurrency, NFT sales, or any other financial product or service;
• disguised donations, tips, wages, commissions, fundraising, charitable solicitations, access fees, subscription fees, paywalls, pay-for-message arrangements, prepayment for services, or other arrangements in which there is no bona fide creator gift being funded through the Services; and
• any other product, service, item, or arrangement that is prohibited by law, by payment processors, by card-network rules, or by the compliance requirements of discreet.gg or its vendors.

We may interpret and apply the foregoing restrictions broadly and in light of current legal, banking, and processor requirements. The fact that a listing, profile, or checkout appears on the Services does not mean that discreet.gg has reviewed, endorsed, or approved it.

Representations and warranties

You represent, warrant, and covenant that: (a) all information you provide to discreet.gg is and will remain true, accurate, current, and complete; (b) you own or control all rights necessary to use and authorize discreet.gg to use your User Generated Content as contemplated by this Agreement; (c) your use of the Services, your User Generated Content, your listings, your referrals, and your conduct will not violate any applicable law, regulation, third-party right, processor rule, or contractual restriction; (d) you will not misrepresent the nature of any listing, payment, reward, affiliation, endorsement, or identity; and (e) you will use the Services in good faith and only for their intended purpose.

You further represent and warrant that you will not use the Services to process or facilitate transactions on behalf of undisclosed third parties, to route money where no real gift transaction exists, to evade chargeback monitoring or compliance controls, or to create an inaccurate or misleading impression regarding discreet.gg, Discreet Labs LLC, any creator, any buyer, or any third-party integration provider.

Payments, fees, taxes, reservations, and payouts

discreet.gg is the buyer-facing checkout surface for current gift-funding flows. Checkout amounts, platform fees, service fees, processing fees, taxes, currency, reservation windows, and any other payment terms shown at checkout control the specific transaction. A payment is not complete unless and until the relevant payment processor confirms the transaction. discreet.gg may create temporary gift reservations during checkout and may release or expire those reservations if payment is not completed within the applicable session window.

Creator payouts are currently routed through Stripe Connect to a creator's linked Stripe Express account. To receive payouts, a creator must complete payout onboarding and remain eligible for charges and payouts under Stripe's requirements. discreet.gg does not control Stripe's underwriting, verification requests, payout schedules, reserve decisions, or other compliance determinations, and we make no representation or warranty that any person will qualify for a connected account or that payout timing will be uninterrupted or predictable.

Unless discreet.gg expressly states otherwise in the product, creators receive the listed gift subtotal for funded gifts and buyer-facing fees are disclosed separately. Buyers acknowledge that discreet.gg may charge buyer-facing service and processing fees and may present those fees as separate line items. Creators and other payout recipients are solely responsible for taxes, reporting, declarations, and other legal obligations arising from payments or payouts they receive through the Services.

Refunds, disputes, and reversals

Refunds, disputes, chargebacks, processor investigations, fraud reviews, compliance holds, or payment reversals may affect transactions that previously appeared complete. discreet.gg may, in its discretion or as required by Stripe or another provider, delay, reduce, reverse, recover, net, or otherwise adjust creator-side amounts, referral-side amounts, reservations, availability status, or related internal records in order to reconcile the applicable payment event.

You acknowledge that a creator's apparent balance, a buyer's completed checkout, or a referral recipient's accrued reward does not create an unconditional or irrevocable right to payment where a refund, dispute, reversal, compliance issue, or other downstream payment event later occurs.

Referrals, promotions, and disclosure obligations

discreet.gg may offer creator referral links, referral codes, incentive programs, or similar promotional mechanics from time to time. The then-current rules displayed in the Services or on the applicable referral page govern eligibility, attribution, earning windows, payout timing, thresholds, reversals, and program changes. Referral payouts, if any, are routed through the same connected Stripe account used for creator payouts unless discreet.gg expressly states otherwise.

You may not self-refer, operate duplicate or fake accounts, manipulate attribution, obscure the true source of traffic, or otherwise engage in deceptive, abusive, or low-quality referral conduct. You are solely responsible for complying with applicable advertising, endorsement, disclosure, and consumer-protection laws when sharing referral links or promoting discreet.gg, including making clear and conspicuous disclosures of any material connection where required. discreet.gg may withhold, cancel, reverse, or recover referral rewards where we determine, in our discretion, that a referral was invalid, abusive, misleading, refunded, disputed, or otherwise non-compliant.

Third-party services and integrations

The Services may depend on or interoperate with third-party providers, including without limitation Stripe, Google, Discord, Resend, and age-verification providers. Your use of such services may be subject to separate terms, privacy policies, and technical or compliance requirements imposed by those third parties. discreet.gg is not responsible for the availability, accuracy, policies, acts, omissions, downtime, or decisions of those third-party providers.

Certain features, such as optional public 18+ badges or Discord verification flows, may require account linking or age-verification outcomes. Age verification is not a general promise of platform review of your identity and is currently used only for the specific features indicated in the product. If you configure Discord verification tooling, you represent and warrant that you manage the relevant Discord server or otherwise have the authority to configure roles, channels, and verification settings for that server.

Intellectual property and platform rights

Except for your User Generated Content and other third-party content, the Services, including their design, layout, branding, software, code, workflows, visual assets, and associated intellectual property, are owned by or licensed to Discreet Labs LLC and are protected by applicable intellectual property and other laws. This Agreement does not grant you any ownership right in or to the Services. You may not copy, reproduce, distribute, reverse engineer, scrape, frame, mirror, or create derivative works from the Services except as expressly permitted by law or by our prior written consent.

Suspension, removal, termination, and deletion

discreet.gg may suspend, limit, or terminate your access to all or part of the Services at any time, with or without notice, if we believe such action is reasonably necessary to protect the Services, our users, our vendors, our processors, or our legal or commercial interests, or if we suspect fraud, abuse, prohibited conduct, security issues, misleading activity, excessive disputes, infringement, or non-compliance with this Agreement.

You may request account deletion through the account settings flow made available in the product. Account deletion removes access to the account and deletes or disconnects user-linked creator data from the app to the extent reflected in our systems, but discreet.gg may retain limited audit, payment, tax, security, fraud, compliance, or legal records where retention is reasonably necessary or legally required.

Disclaimer of warranties

THE SERVICES ARE PROVIDED ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, OR THAT THE SERVICES WILL BE SECURE, UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Without limiting the foregoing, discreet.gg makes no representation or warranty regarding any creator, buyer, listing, referral, payment outcome, payout timing, content review result, verification outcome, third-party integration, or the continued availability of any feature or program.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DISCREET LABS LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, SUPPLIERS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, BUSINESS INTERRUPTION, DATA, EXPECTED PAYOUTS, EXPECTED REFERRAL REWARDS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Without limiting the foregoing, discreet.gg shall not be responsible for losses or liabilities arising from user conduct, user-generated content, disputed payments, chargebacks, processor or banking decisions, third-party service outages, content or account removals, or events outside our reasonable control.

Indemnification

You agree to defend, indemnify, and hold harmless Discreet Labs LLC and its members, managers, officers, employees, contractors, affiliates, vendors, successors, and assigns from and against any claims, demands, actions, proceedings, investigations, liabilities, damages, judgments, settlements, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to: (a) your access to or use of the Services; (b) your User Generated Content; (c) your listings, referrals, promotions, or payment activity; (d) your breach of this Agreement; or (e) your violation of any law or any third-party right.

Changes, severability, and general terms

discreet.gg may modify these Terms of Service from time to time, and the then-current version posted on this page will govern future use after posting. If any provision of this Agreement is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect. No waiver by discreet.gg of any breach or default shall be deemed a waiver of any preceding or subsequent breach or default.

This Agreement constitutes the entire agreement between you and Discreet Labs LLC with respect to the Services and supersedes prior or contemporaneous understandings to the extent they relate to the same subject matter.
